NOTICE OF SALE GEORGIA, COLQUITT COUNTY. WHEREAS, heretofore on April 11, 2022, THOMAS GARRETT WESTBROOK did execute to TC FEDERAL BANK, a certain security deed to the following land: All that certain piece, parcel or tract of land situate, lying and being in the 8th Land District of Colquitt County, Georgia, and being designated as Lots 17 and 18 in Block 5 of Riverwood Subdivision according to a plat of survey prepared by Robert P. Jolley, Surveyor, of date July 30, 1979. Recorded in Plat Book 13, Page 138, Colquitt County records, which said plat and the record thereof are by reference incorporated herein. The above described property is known as 144 Bull Creek Road, Moultrie, Georgia 31788-7053. WHEREAS, said security deed secures a Credit Agreement and Disclosure dated April 11, 2022 (the Note) in the original amount of EIGHTEEN THOUSAND 00/100 DOLLARS ($18,000.00), all shown by a security deed recorded in Deed Book 1496, Pages 0223-0231 in the office of the Clerk of the Superior Court of Colquitt County, Georgia (the Security Deed); and WHEREAS, THE NOTE AND SECURITY DEED WERE TRANSFERRED AND ASSIGNED TO JOURNEY RESIDENTIAL, LLC BY A TRANSFER AND ASSIGNMENT DATED JANUARY 31, 2024, WHICH IS IN THE PROCESS OF BEING RECORDED IN THE DEED RECORDS OF COLQUITT COUNTY, GEORGIA; AND WHEREAS, the Note is delinquent and a default exists, and the default continues, and all notices required in the note and security deed have been timely given, and Journey Residential, LLC elected that the entire debt, principal and interest, become due at once as provided in the Note and Security Deed, and the undersigned elected to proceed with foreclosure under its security deed; and NOW, THEREFORE, according to the original terms of said security deed and pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in March, 2024 between the legal hours of sale before the Colquitt County Courthouse, 9 South Main Street, Moultrie, Georgia. Said property will be sold subject to taxes for the year 2024 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the security deed first set out above. The proceeds from said sale will be used, first to the payment of said debt, principal, interest and expenses and attorneys fees for which proper notice is given, and the balance, if any, delivered as provided in said security deed.
