NOTICE OF SALE GEORGIA, COLQUITT COUNTY. WHEREAS, heretofore on June 28, 2019, RICKY RAY SPARKMAN AKA RICKY R. SPARKMAN AND YVONNE L. SPARKMAN did execute to UNITED NATIONAL BANK a certain Deed to Secure Debt to the following land: One acre in Land Lot 194 in the 8th Land District of Colquitt County, Georgia, as shown by a plat titled Property of Ricky Ray and Donna Kay Sparkman dated June 10, 1980, prepared by Hurley J. Griffin, Georgia Registered Surveyor, same being recorded in Plat Book 12, Page 161, Colquitt County records, said lot being more particularly described as follows: To arrive at the point or place of beginning, proceed 240 feet West from the southeast original corner of Land Lot 194 along the southern line of said Land Lot 194 to the West margin of a public road leading North from the Moultrie-Camilla Highway through the lands now or formerly of W. C. King to the Sale City and Giles Mill public road, and from said point, proceed in a northeasterly direction along the West margin of said road 200 feet to the POINT OR PLACE OF BEGINNING; thence proceed 83 feet North 88 degrees 53 minutes 12 seconds West to a point; thence run 359.68 feet North 00 degrees 30 minutes 56 seconds West to a point; thence run along a fence line 168.00 feet South 75 degrees 58 minutes 40 seconds East to a point; thence run along another fence line 129.86 feet South 10 degrees 54 minutes 30 seconds West to a point; thence along the same fence line 100.00 feet South 15 degrees 07 minutes 13 seconds West to a point; then along the same fence line 99.99 feet South 15 degrees 08 minutes 22 seconds West to the point or place of beginning. Subject to existing easements for public utilities and for Rossman Dairy Public Road. The above described property is identified as 1203 Rossman Dairy Road, Moultrie, Colquitt County, Georgia 31768 and Tax Parcel No. C028 096. WHEREAS, said Deed to Secure Debt secures a Promissory Note and Security Agreement dated June 28, 2019 in the original amount of ONE HUNDRED FORTY THOUSAND AND 00/100 DOLLARS ($140,000.00) and all other indebtedness then owing or thereafter arising between the parties, all shown by a Deed to Secure Debt recorded in Deed Book 1376 Pages 0282-0286 in the office of the Clerk of the Superior Court of Colquitt County, Georgia. WHEREAS, the note is delinquent and a default exists, and the default continues, and all notices required in the note and Deed to Secure Debt have been timely given, and the undersigned has elected that the entire debt, principal and interest, become due at once as provided in the note and Deed to Secure Debt, and the undersigned has elected to proceed with foreclosure under its Deed to Secure Debt. NOW, THEREFORE, according to the original terms of said Deed to Secure Debt and pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in May 2024, being May 7, 2024 between the legal hours of sale before the Colquitt County Courthouse, 9 South Main Street, Moultrie, Colquitt County, Georgia. Said property will be sold subject to taxes for the year 2024 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Deed to Secure Debt first set out above. The proceeds from said sale will be used, first to the payment of said debt, principal, interest and expenses and attorneys fees for which proper notice is given, and the balance, if any, delivered as provided in said Deed to Secure Debt.
