NOTICE OF SALE UNDER POWER GEORGIA, COLQUITT COUNTY Because of a default in the payment of the indebtedness, among other possible events of default, contained in a Deed to Secure Debt from Kirk Blount to Commercial Banking Company dated June 9, 2016 and recorded in Deed Book 1270, Page 164 Colquitt County, Georgia records, securing a Consumer Note in the original principal amount of Twenty-Four Thousand Two Hundred Twenty-Eight and 34/100 ($24,228.34), the holder thereof pursuant to said Deed to Secure Debt and Consumer Note has declared the entire amount of said indebtedness (including all renewals, modifications and extensions) due and payable and pursuant to said power contained in said Deed to Secure Debt will on the first Tuesday in September 2019, during the legal hours of sale before the Courthouse door in said County, sell at public outcry to the highest and best bidder for cash the following property to-wit: Lot No. 1 and the East half of Lot No. 2 in Block "A" of the Ashburn Subdivision to the City of Moultrie, Georgia, said lot fronting 90 feet on the North margin of First Avenue, S.W., and extending back northward of uniform width a distance of 138 feet, as shown on said plat of said Subdivision on record in the Office of the Clerk of Superior Court in Deed Book "Z", Page 508. Bounded North by lands now or formerly of Rouse; South by First Avenue, S.W.; East by lands now or formerly of H.A. Young and being the same premises conveyed to Chiquita Y. Taylor by deed recorded in Deed Book 992, Page 181, Colquitt County records. Said described property is known and designated as 418 1st Ave. SW, Moultrie, Colquitt County, Georgia 31768. Said property will be sold subject to all applicable restrictive covenants and/or easements of record and any taxes or assessments which may be a lien against said property. In addition said property will be sold subject to any matters which might be disclosed by an accurate survey and inspection of the property and to all matters of record in the Office of the Clerk of the Superior Court of said County. Notice has been given of the Holder's intention to collect attorney's fees in accordance with the terms of the Consumer Note and the Deed to Secure Debt. Said property will be sold as the property of Kirk Blount and the property, to the best information, knowledge and belief of the undersigned being presently in the possession of Kirk Blount. Proceeds of the sale will be applied to the payment of all indebtedness collateralized by said Deed to Secure Debt and all expenses of said sale, including attorney's fees as provided in said Deed to Secure Debt, and the balance, if any, will be distributed as provided by law.
